The birth of a child is one of the most joyful times in a parent’s life. Unfortunately, some deliveries are difficult, complications arise, and injuries occur.

The joy and excitement can be quickly replaced by anxiety and fear for your child’s health. At Gilormo Injury Law, we know how terrifying it can be if your child has suffered a birth injury. Atlanta birth injury lawyer Amber Gilormo provides dedicated, compassionate legal representation to families in their time of need with offices in Atlanta, Alpharetta, and Cumming helping them protect their child’s health and future.

Understanding Birth Injuries

Birth injuries are injuries suffered by the child during the labor and delivery process. The physical pressure that occurs as the child moves through the birth canal can cause a number of injuries. These injuries are sometimes the result of natural factors, and sometimes the result of medical malpractice.

It’s difficult to say how many birth injuries occur every year in the United States, but some studies claim that the occurrence is as frequent as seven out of every 1,000 births. Regardless of the statistics, birth injury cases are among some of the most common medical malpractice cases that lawyers handle. Although they are common, birth injury cases can also be among the most complex personal injury claims.

Our Atlanta Birth Injury Lawyer Explains Which Injuries Can be Caused by Negligence

The principal challenge in birth injury cases is determining whether or not the injury is the result of the doctor or hospital’s negligence. This can be difficult because many birth injuries can be the result of natural causes:

  • The baby is unusually large
  • The baby was born prematurely
  • The baby was in an unusual position for delivery (breech births)
  • The size or shape of the birth canal caused a difficult delivery
  • Prolonged labor

Other birth injuries are the result of the doctor or hospital failing to meet the applicable standard of care. For example:

  • Failing to identify particular risks or make the correct diagnosis
  • Failing to provide adequate supervision during the labor and delivery process
  • Failing to adequately monitor the baby’s vital signs during birth
  • Allowing labor and delivery to carry on for an unnecessarily long period of time

There is a broad spectrum of factors that can result in birth injuries. Unfortunately, there are often multiple factors involved that can make it difficult to determine whether negligence has occurred. For example, the baby may be unusually large, but an experienced doctor may not have delivered the baby in a way to minimize the risk of injury.

An experienced Atlanta birth injury lawyer can review the facts of your case and determine whether you may have a claim.

Common Birth Injuries in Georgia

In general, birth injuries tend to fall into one of three categories:

  • Bone fractures and torn ligaments
  • Nerve damage
  • Brain damage

Bone fractures, torn ligaments, and nerve damage are typically caused by too much force or pressure while birthing the child. Brain damage, however, is often caused by a lack of oxygen to the baby’s brain. These injuries are commonly diagnosed as the following conditions:

  • Cerebral Palsy is the result of damage to the nervous system and affects the brain’s ability to control the motor functions of the rest of the body. Many believe that it can be caused by the use of forceps during birth.
  • Erb’s Palsy is the paralysis of the arm or hand that results when the group of nerves is damaged during birth. This can be the result of pulling with too much force during delivery.
  • Birth Asphyxia is when the child is deprived of oxygen during birth, resulting in brain damage.
Cephalohematoma is the collection of blood beneath the cranial bone when blood vessels are broken during delivery and can lead to jaundice and anemia.
  • Facial paralysis caused by too much pressure on the child’s face resulting in mild to severe nerve damage.
  • Spinal injuries can be caused by the improper use of forceps and can result in paralysis or other neurological problems.
  • Caput Succedaneum is the extreme swelling of the soft tissues in the baby’s scalp and is often the result of using a vacuum extractor incorrectly. It can result in jaundice, and if undiagnosed, result in brain damage in some cases.

What You Should Do if Your Infant is Injured

We trust our doctors and health care providers to do their very best in giving us the care that we need. Unfortunately, even conscientious healthcare providers can fail to meet the standards they are required to meet when caring for you and your child. We are trained to trust our health care providers, but you should trust your instincts and seek professional guidance.

If you suspect that your child has suffered a birth injury, the best thing to do is speak with experienced Atlanta birth injury lawyers as soon as possible. Our team will review your case, determine whether the hospital or doctor was at fault, and help you understand your legal options. If you haven’t already received a diagnosis, it is very likely that we will be able to refer you to a doctor who can give you expert medical advice. Your lawyer can also help you gather the evidence you will need to make your claim and build the strongest possible case.

You May Be Entitled to Compensation, Consult with an Atlanta Birth Injury Lawyer

Your child’s birth injury may require extensive medical care, and the costs can go far beyond your medical bills. If your child was injured during delivery as a result of negligence, you may be entitled to compensation for the following:

  • Current medical expenses, including any out-of-pocket expenses such as co-pays or deductibles
  • Future medical expenses including physical or occupational therapy
  • Any income you lost to seek medical treatment or care for your child

  • Pain and suffering

An Atlanta birth injury lawyer will be able to review your case and provide an estimate of what your claim may be worth.
