Uber Accidents

Amber is heaven sent!! Amber and her team worked very hard on my case!! They checked on me while I had my weekly doctor visits. They were very detailed with my settlement. I didn’t have to second guess anything. I would recommend her to anybody who is in a car accident !! I’ve even referred my love ones who also needed her to represent them in an accident. She made my process as painless as possible. I wish I could give her 10 stars!!

Jeannette A., Client

I was referred to Amber by my daughter-in-law. I was involved in two rear end collisions in a three month period. She did an excellent job keeping me informed and explained everything to me, in a manner that I could understand. She followed through with me until I had my settlements.

Atlanta Uber Accident Attorney

Popular ridesharing companies like Uber have been competing with traditional taxicab companies over the past decade and, like with taxis, accidents happen. If you’ve been involved in an accident caused by an Uber driver, let an experienced Atlanta Uber accident attorney like those at Gilormo Injury Law Firm with offices in Atlanta, Alpharetta, and Cumming, help you with your insurance and legal claims.

Using Uber to Navigate Atlanta

Uber works like this: Users download the Uber app onto their cell phone, and whenever they need a ride, they simply request it through the app and a driver in the vicinity responds to the location, picks them up, and delivers them to their destination. In many cases, Uber offers a cheaper and quicker alternative to the traditional taxicab. It is especially popular in high-density, metropolitan-type areas like Atlanta.

Uber vs. Taxicabs: What is the Better Option?

Not every taxi driver is necessarily safe or skilled, but they all are employees of a larger company, which means they are screened and background-checked. Taxis are regularly inspected and maintained by the company that owns them.

However, Uber vehicles and drivers are not regulated in the same way as taxicabs. Uber vehicles are owned, maintained, and operated by individual drivers, and Uber seeks to distance itself from its drivers by claiming that they only provide the connectivity platform. It’s not always clear when the vehicle was last inspected, or whether the driver has recently had a background check or drug screening. However, after an accident an Atlanta Uber accident lawyer at our firm can help investigate these facts to help your claim.

Still, since the number of Uber accidents is rapidly increasing, Uber has claimed that their “safe ride fee” covers things such as background checks, motor vehicle screenings, and driver safety education for their drivers.

Insurance Policy Limitations Explained by an Atlanta Uber Accident Attorney

Uber drivers are regular people with no specific training or relation to Uber other than their approval process. These Georgia residents have their own car insurance in addition to the coverage that Uber provides. However, the Uber insurance coverage is only applicable in certain situations during the leg of a trip.

  • Insurance won’t apply when the driver is not using the app.

When a driver is in their vehicle but not using the app, they are considered “offline,” and any accidents that happen during this period are covered by the driver’s personal insurance policy only.

  • Insurance does cover drivers in an “available” status.

When a driver is in their vehicle, using the app, and waiting to accept a ride, they are considered “available,” and are required to have a minimum of $100,000.00 for bodily injuries or the death of any person in any one accident, with a maximum of $50,000.00 for bodily injuries or death of one person and $50,000.00 for loss of or damage to property of others, excluding cargo.

  • Insurance does cover drivers when the route is in use.

When a driver has accepted a ride, before, during, and after pickup they are required to carry $1 million for death, personal injury, and property damage per occurrence and uninsured and underinsured motorist coverage of at least $1 million per incident.
